Civil law cases

We offer our legal assistance in all civil law cases, in particular regarding issues such as:

• providing advisory services and representation before common courts in claims for compensation arising out of, among others: traffic accidents, medical negligence, accidents, accidents at work, defective performance or non-performance of contracts,
• claiming compensation from insurers and perpetrators of accidents as a result of harm to a person or damage to property,
• claiming liquidated damages,
• providing advisory services and representation before common courts in cases such as, for example: protection of personal rights, claims for payment, establishing rights, revoking donations, establishing or revoking easements, usucaption,
• Preparing, analysing and providing legal opinion on all types of contracts used in civil transactions such as contracts of sale, contracts for performance of a specific task, contracts for construction works.

Court and bailiffs

We support our Clients in cases before administrative and common courts and before executive authorities, in particular regarding the following cases:

• providing advisory services and representation before common courts in cases such as civil law, employment law, family law, commercial law, cases related to the division of joint marital property, division of inheritance, dissolution of co-ownership and inheritance, among others,
• providing advisory services and representation before administrative courts in administrative and tax law related cases, among others,
• providing advisory services and representation before enforcement authorities (bailiffs and state administration authorities).

Inheritance

We support our Clients in conducting inheritance cases, in particular regarding the following issues:

• advising on the selection of the best legal solutions, which guarantees fully that the testator’s will be followed,
• representing Clients before common courts and conducting cases such as: division of inherited assets, right to leigitime, disinheritance and declaring an heir unworthy of inheritance.

Employment law

We provide support to our Clients in solving problems with employers, in particular regarding the following issues:

• providing advisory services on entering into, changing and terminating employment contracts,
• providing advisory services and representation before common courts in cases such as, for example: reinstatement to work or obtaining compensation, infringement of employee’s personal rights, harassment at work, remuneration for working overtime and during public holidays, payment of holiday entitlement,
• providing advisory services on and analysing non-competition covenants and contracts on employee’s material responsibility.

Family law cases

We offer support and assistance in difficult moments in life related to claiming rights under family law, in particular regarding the following issues:

• providing advisory services and representation before common courts in cases such as: divorce, separation, establishing the existence or nonexistence of marriage and the annulment of marriage,
• providing advisory services and representation before common courts in cases such as: division of joint matrimonial property (in court proceedings or through a prenuptial agreement),
• providing advisory services and representation before common courts in cases such as: parental rights, establishing parenthood, incapacity and guardianship and custody.

Real estate

We offer advice in all issues related to providing legal services related to the real estate market, in particular we conduct cases with respect to the following issues:

• verifying the legal status of real estate,
• providing advisory services and representation in administrative proceedings related to investment process,
• preparing, negotiating and providing legal opinions on real estate sale contracts, contracts with developers, contracts of lease, contract of tenancy, contract of agency in real estate trade, contracts on real estate management – in particular with respect to the elimination of prohibited clauses, construction contracts,
• providing advisory services in cases related to eviction, payment of rent, compensation for unjust use of real estate,
• providing advisory services and representation in cases related to the dissolution of joint ownership of real estate,
• conducting proceedings related to entries on rights to real estate into the Mortgage and Land Register.

Assistance in dealing with official authorities

We provide help with all kinds of problems related to administrative law and in dealing with official authorities, in particular in the following cases:

• representing Clients before state and local authorities in cases related to construction law, zoning issues, co-operative law, environment protection law, sale of alcohol, among others
• preparing appeals and complaints against decisions,
• preparing complaints to administrative courts,
• representing Clients in cases related to challenging resolutions of local government units.

Taxes

We offer assistance in dealing with tax related issues, in particular in the following aspects:

• representing Clients during inspections of tax offices and tax chambers,
• representing clients in tax proceedings and before administrative courts,
• tax optimisation,
• drafting applications for tax interpretation,
• advisory services on the interpretation of tax law provisions and the selection of favourable and secure methods of their application, in particular within the scope of the provisions of the Ordinance on Rules of Taxation, Personal Income Tax Act, donations and inheritance tax, tax on civil law transactions, local taxes and fees (the so-called real estate tax),
• representing Clients during administrative enforcement proceedings.

It is worth remembering that in the case of a dispute with a tax office it is advisable to seek legal assistance from the very beginning so as to be able to plan further action and calculate the chances of a positive outcome to the proceedings.

Kredyty frankowe

Oferujemy analizę, doradztwo i reprezentację w sporze przeciwko bankom udzielającym kredytów we frankach szwajcarskich, a w szczególności zajmujemy się następującymi sprawami:

• analiza prawna zawartej z bankiem umowy, zarówno pod kątem zgodności z przepisami prawa jak i występowania klauzul niedozwolonych (skutkujących podważeniem części lub całości umowy),
• kalkulacja spornej kwoty wykonana we współpracy z Biegłym z zakresu Wyceny i Doradztwa Ekonomicznego,
• reprezentacja w negocjacjach z bankiem prowadzonych na drodze ugody,
• doradztwo i reprezentacja przed sądami powszechnymi w sprawach o „odfrankowanie” lub unieważnienie umowy.
